Mackenzie Vargas, about 15, of Albuquerque, was arrested Nov. 15 for shooting at a dwelling or occupied building, shooting at or from a vehicle, unlawful carrying of a handgun by a person under 19, negligent use of a deadly weapon and aggravated assault with a deadly weapon in Rio Rancho.

Officers received a shooting in progress call for service in the 1800 block of Sierra Norte Loop in which a white pickup with an ATV loaded onto the bed had shot at the occupied residence and was last seen headed east toward Unser Blvd. Officers saw a vehicle matching the description turn south on Unser Blvd. at its intersection with Northern Blvd.

Officers conducted a traffic stop on the vehicle in the Legacy Church parking lot, 1000 Premiere Parkway. After detaining the occupants, the rear driver’s side passenger was identified as Vargas.

Vargas told police she was at the listed address to obtain a refund for the ATV she had purchased. Vargas added the previous owner said they would not return the money, which angered her. She said she used a silver handgun and began shooting toward the vehicle in the driveway in order to cause property damage equaling what she spent on the ATV.

She said she shot an unknown number of times toward the vehicle and residence and then drove away. Vargas stated she threw the handgun in the bed of the trunk as she thought she would be in trouble for the shooting.

A silver handgun was located in the bed of the listed truck, and several spent shell casings were located on scene and inside the vehicle.
