Rio Rancho Police arrested Martin Martinez, 21, of Espanola, March 29 for two counts of aggravated assault with a deadly weapon.

According to a criminal complaint provided by RRPD, officers responded to a call at 11:22 p.m. in response to an active armed subject at The Local Brewhouse on Unser Blvd.

The caller told dispatch there was a man standing next to a white Mercedes pointing a gun at multiple people at the brewhouse.

When officers arrived on scene, they saw Martinez standing next to a white Mercedes and detained him and separated him from a female also standing by the vehicle.

Martinez agreed to speak to officers after being read his rights. He told officers that he was being jumped by multiple subjects and pulled the gun for fear of his safety.

Officers also spoke to seven bar patrons who all had the same story — that they believed a domestic violence incident was occurring between Martinez and his girlfriend.

The situation got physical between two of the patrons and Martinez, who then pulled the gun out of the car. He pointed the gun at the two he had been fighting with and five others nearby.

Martinez’ girlfriend is the registered owner of the car and gave police permission to search the vehicle. In plain sight was a black Glock under the passenger seat. They also saw a live round on the floor of the car and a magazine in the cup holder.

Due to the intensity of the situation, Martinez was identified as the aggressor.

All items were taken into evidence. Martinez was booked into Sandoval County Detention Center.

He will face a year and a half of jail time and/or a $5,000 fine if convicted.
