Gilbert Hernandez, 35, of Albuquerque, was arrested Jan. 29 for trafficking, receiving stolen property, DUI and two counts of possession of a controlled substance on Sara Road.
Officers responding to a report of a swerving vehicle that was driving into oncoming lanes of traffic found Hernandez passed out at the steering wheel with the engine running and a bag of fentanyl in his hand.
They helped him out of the vehicle, but he repeatedly resisted and tried to put the car in drive a few times. Officers managed to cuff him and put him in the back of a police vehicle. Hernandez admitted to smoking fentanyl a couple hours before police detained him.
Officers also found a black handgun in the pocket of the door. Hernandez said he bought it from a friend and that it belonged to him. The gun came back as stolen in the Albuquerque police data base.
While officers were escorting Hernandez to a holding cell, a bag of fentanyl fell out of his genital area. When officers searched him further, they found fentanyl pills, meth and suspected Diazepam.
Hernandez will serve 13 1/2 years in prison if he is convicted.
