NOTICE is hereby given that on October 12, 2021 EOG Resources, Inc., c/o Andrea Felix, 104 S 4th Street, Artesia, NM 88210, filed with the NEW MEXICO OFFICE OF THE STATE ENGINEER Notice of Intention number SJ-4493 to drill one well to Appropriate Nonpotable Groundwater from an aquifer the top of which is at a depth of 2,500 feet or more pursuant to NMSA 1978 §§ 72-12-26 and 27.

The well will be drilled to an anticipated depth of 7,400 feet below ground surface, constructed of 7 5/8″ outside diameter casing, and will have all water production isolated within the Entrada Formation Aquifer. The subject well is located 54 miles south and east of the City of Bloomfield, San Juan County, New Mexico. The projected point of diversion is located on Bureau of Land Management (BLM) land and can be approximately located as follows: SE/4 NW/4 of Section 1, T21N, R5W, Sandoval County, at a point where the Latitude is 36° 4′ 50.6316″ N, and the Longitude is 107° 18′ 55.7136″ W. EOG intends to divert up to 471 acre-feet of water per annum for an estimated 10-year period from the Entrada Formation Aquifer in the San Juan Basin. The requested diversion will be used to supply nonpotable water for oil and gas exploration and development operations on private, State, and BLM lands within San Juan, Sandoval, and Rio Arriba Counties, New Mexico. Upon completion of use the diverted water is proposed to be reinjected into the Entrada Formation. Any person may bring an action to the district court of the county in which the subject well is situated for damages or injunctive relief with respect to any claimed impairment of existing water rights due to an appropriation of nonpotable water under 72-12-25 to 72-12-28 NMSA 1978.

Applications to appropriate nonpotable water under § 72-12-28 are not subject to protest or hearing before the State Engineer.
