According to a criminal complaint filed by Rio Rancho Police Department, Tyler Wagner, around 41 years old, of Rio Rancho, was arrested for aggravated assault with a deadly weapon and battery on May 26 at a residence in the Meadowlark Apartments.
Officers responded to the apartment at around 2:30 p.m. when a call came in reporting that Wagner had entered the residence and refused to leave.
The callers, who identified themselves as remodeling workers, told dispatch they did not know who the man was and that he kept yelling. They told officers they were working on the home’s tiling when Wagner entered the residence and started yelling at them.
Wagner was reportedly holding an object in his hand and began chasing the two men around the home and outside of the residence. Wagner was telling them that he owns the home and they were not supposed to be there. At one point, Wagner struck one of the workers with the metal object and caused his finger to bleed.
Both workers believed the weapon Wagner held in one hand would cause great bodily harm and the object in the other hand appeared to be a knife.
Wagner admitted that he entered the home because he did not believe the men were supposed to be there. He also placed belongings on the ground of the garage and stated he was going to own the home. He was never given permission to enter the home.
If convicted, Wagner could face up to two years for the assault and battery charges.
