A 40-year-old man reportedly broke into a DK station convenience store in Rio Rancho June 5 causing more than $1,000 in damages.

At about 1:15 a.m., Rio Rancho police officers were dispatched to a call of a burglary at the service station at 2211 Unser Blvd.

Dispatch said that a caller had pulled up to the gas station and reported seeing broken windows and a man, later identified as Oryan Yazzie, standing inside.

When officers arrived at the scene, the suspect acted “very anxious and excitable,” according to a criminal complaint.

He quickly walked out of the store and was subsequently arrested.

As Yazzie was being escorted to the patrol car, he said there was another man inside the station with a firearm. Another officer checked to see if there was anyone else inside the building, but no one was found.

Video surveillance showed the suspect breaking a window before going inside and damaging numerous items like an electronic self-checkout machine and cash register, according to the complaint.

The building had several broken front windows and “extensive damage” inside. Bar stools and merchandise were scattered everywhere. Blood was smeared all over, the complaint states.

Yazzie, who was bleeding from several places including his elbows and head, had a hospital bracelet on his wrist. He told officers he had just been released from the hospital.

The suspect was taken to an area hospital to be examined before going to the Sandoval County Detention Center.

Yazzie is accused of nonresidential burglary and criminal damage to property (over $1,000).  Both are fourth-degree felonies.

He gave no plea at his initial appearance on Monday.

If convicted, Yazzie could face up to 3 years in prison and pay a $10,000 fine.

The complaint does not state how the suspect received his injuries nor why he had previously been at the hospital.
